Who we are and what these terms cover

These terms of service govern the Beiyuan plant marketplace and green care platform, which is operated and owned by a company in Hong Kong (HK) that carries its full details below. They cover every visit, every order, every subscription, every plant doctor visit, every office scheme and every workshop or event we hold or host.

In these terms the words we, us and our refer to Dawnshine EverGreen Limited, and the words you and your refer to the person or company using the platform. When we ask you to agree to something we mean Dawnshine EverGreen Limited agreeing with you in return under the same terms.

Accepting these terms

By placing an order, subscribing to a box, booking a workshop, sending a care enquiry or otherwise using the platform, you confirm that you have read these terms and that you accept them. If you do not agree to any part of them, please do not place an order and instead contact us to ask a question.

These terms sit alongside our privacy policy, which explains how we use personal information. Both documents work together. Where a delivery begins at our Mong Kok glasshouse and ends at a workplace you run, these same terms apply unless a written contract with that company states otherwise.

Accounts and your responsibilities

Certain services such as subscriptions call for an account. To keep your account and every order safe you agree to the following.

  • Provide true and current details about yourself and, where relevant, the company you represent.
  • Keep your password and sign in details secret and tell us straight away if you suspect they have been shared.
  • Give a delivery address where someone can receive a parcel, and notify us promptly of any move.
  • Ensure that the person you name for an office scheme or corporate visit is aware that you have given us their details.

You are responsible for all activity that happens under your account, so please treat it as carefully as a prized specimen.

Orders, pricing and payment

Prices shown on the platform are in the currency stated at the point of order unless a written quote says otherwise. We take reasonable care that prices are correct, but a genuine mistake may occur. Where a price is plainly wrong we will tell you before charging and give you the choice to proceed at the correct price or to cancel with nothing owed.

An order is accepted when we confirm it to you by email or over the phone and a contract is formed at that moment. Payment for orders is taken securely at the time of acceptance unless we agree a credit arrangement with a business client. We accept the payment methods listed at checkout. All card payments are processed by a certified provider and your full card number never reaches our systems.

For business and corporate work we prepare a written proposal that states the scope, the schedule and the price. That proposal is an invitation to treat, and our acceptance of your signed instruction forms the binding contract for the project.

Delivery of plants and goods

We aim to deliver orders placed before noon on the same day across most of Hong Kong, and to schedule delivery for the date you choose. Delivery times are best-effort estimates and not guaranteed times, although we work hard to honour them.

  • Boxes cut to the pot keep plants upright and cushioned during transit.
  • You must be ready to receive the delivery at the agreed address and time.
  • If nobody is available we will attempt to arrange a safe place or a redelivery at a time we can both agree.
  • Risk in the goods passes to you when they are handed to you or left in an agreed safe place.

Once a plant leaves the glasshouse it enters your care. Please water and place it according to the care card within the first day so that the journey is a pause, not a setback.

Seedlings raised in our own covered beds arrive more accustomed to indoor life, and we refresh them before dispatch so that every plant meets you well hydrated. If a specimen you ordered is out of stock we will offer you a like-for-like substitute or a full refund, and we will never send a different plant without telling you first. Numbers, sizes and species on listings describe the plant as it is offered, and slight natural variation between specimens is part of the charm, not a defect.

Subscriptions and swaps

Plant subscription boxes renew on the schedule you select until you pause or cancel in your account, or by contacting us. You may pause a plan for a trip or a busy season without losing your place.

  • Each box brings a fresh specimen, a pot, a care card and feed matched to your light.
  • Each delivery carries a two week swap window. If your specimen is not suited to your light or routine, tell us and we collect it and deliver a better match, with no return postage on your side.
  • Swaps apply to the plant itself; made-to-order vessels and prints are not part of this window.
  • You may cancel at the end of any paid cycle with a month of written notice, or sooner where your payment method allows a stop on the next renewal.

We may pause or end a subscription where payment repeatedly fails or where a delivery address is no longer valid, and we will tell you in advance whenever we reasonably can.

Plant doctor and care services

Plant diagnostics and visits are advice and care services. A plant doctor will read the signs you share and give an honest recovery plan, but no diagnostic can promise that every plant will recover, because so much depends on timing and on the exact condition we cannot always see behind the soil.

For remote diagnostics you agree to share clear photographs that show the true condition of the plant. For site visits you agree to provide access at the agreed time and a safe place for us to work and to set down tools and feed. Our advice is given for the specimen you describe and should not be read as a general instruction for other plants in different rooms.

Office greenery and corporate landscaping

Office and corporate work is delivered under a written scope that lists the zones, species, schedule and price. You agree to provide safe site access, clear working conditions and, where planters stand near water, plumbing or electrical points, a walkthrough at the start. Where a building entry desk asks every supplier to register, we will supply the paperwork you need before we arrive rather than adding to your admin.

  • We fit the service into the stated opening hours so your team is not disrupted.
  • Tenderers follow a fixed rotation and report on each zone.
  • Replacements are included under your maintenance term where our own tender missed a need.
  • Changes beyond the scope are treated as new works quoted separately.

If you provide access that is unsafe or repeatedly unavailable we may reschedule visits without a penalty to you, and we will notify you of any delay as soon as we know.

Workshops and events

Workshop places are confirmed once you and we both accept the booking, and attendance is by adults over eighteen unless a session is explicitly marked for young people with a responsible adult present. We supply all plants, materials and tools, and you agree to follow the demonstrator guidance so that the session stays safe and calm for everyone.

  • Reschedule requests reach us at least 48 hours before the start without a fee.
  • Cancellation by you with less notice may keep a deposit or incur a small charge described at booking.
  • If we must cancel a session for reasons beyond our control, we reschedule or refund in full.
  • Personal tools and plants brought to private events remain the guest responsibility.

We photograph our own green classroom from time to time. Where a guest does not wish to appear, they should tell us before the session and we will keep them out of any shared frame.

Plant health guarantee and returns

Strong plants are the point of our work, and we stand behind every specimen we sell. Our guarantee is honest and practical.

  • If a plant arrives damaged in transit, photograph it within 48 hours and we replace it or credit you in full.
  • If a plant fails within the first fourteen days through no fault in your care, we replace it, guided at no charge by our plant doctor.
  • For subscription specimens the two week swap window covers light mismatches as well.
  • The guarantee does not cover neglect such as prolonged drought, full shade for a sun plant, or a pot left sitting in standing water for many days.

To make a claim simply write to us with a photograph and the order number. We will not make you carry a heavy pot back to Mong Kok; where a replacement is due we arrange collection or credit as suits the case.

Refunds and cancellation

Your money should never be a hostage once you have changed your mind. Our refund rules are as follows.

  • Order not yet dispatched : a full refund on request.
  • Order dispatched and refused : a refund of the item price once the goods return to us, less outbound and return delivery.
  • Subscription plans : refunds for the unused portion of a prepaid period where a claim is valid, else a credit for your next order.
  • Business and corporate projects : cancellation terms are set in the written proposal so you are never left guessing.

Refunds are issued to the original payment method and appear within the normal settling time of that bank. If a delivery is late by a margin outside what we promised you in writing, we will make a goodwill arrangement with you.

Acceptable use and conduct

We want the platform to remain a calm, honest corner of the web. You agree not to use it in any way that does the following.

  • Breaks an applicable law or our operating licence in any place.
  • Harasses, threatens or misleads our staff, our technicians or other customers.
  • Submits false diagnostic photos or false claims of damage for the purpose of gain.
  • Interferes with the site, with payments or with the accounts of others.
  • Attempts to gain unauthorised access to any part of our network.
  • Sends unsolicited bulk mail through our forms or overloads our services.

We may suspend an account where conduct risks other customers or our staff, and we will give reasons promptly except where doing so would itself be unlawful. A suspension is never a first resort; we would always try a polite warning and a chance to correct course before putting the watering can away.

Intellectual property

All text, layouts, plant illustrations, care sheets, brand names, word marks and materials on this site belong to Dawnshine EverGreen Limited or to the owners who license them to us. They are protected by copyright and trade mark law.

  • You may view and print site content for your own private use.
  • You may link to our pages from a public website where the link is honest and not misleading.
  • You may not copy, scrape, republish or redistribute our content for commercial gain without our written permission.

The names Beiyuan, EverGreen and Dawnshine, along with the frond and glasshouse motifs, are marks of ours or of our licensors, and nothing here grants you a right to use them.

Liability and disclaimers

We provide plants and care services with care and honesty, but we cannot make promises beyond what the law allows the company to make. Our terms on responsibility are set out plainly below.

  • Nothing in these terms limits liability that cannot be limited by law, such as liability for death, personal injury or fraud.
  • We serve living things. Conditions such as light, water, air and pest pressure sit with the environment you provide, so our responsibility does not extend to every possible failure of a plant after it leaves our care.
  • To the fullest extent permitted, our total liability for any one claim about a product or service is limited to the amount you paid for that product or service.
  • We are not liable for delays or failures beyond our reasonable control, such as a storm, a port closure, a strike or an act of government, though we will do our best to reschedule.
  • We do not warrant that the site will be error free or available at every moment, though we run checks and aim to keep ordering smooth around the clock.

Governing law and disputes

These terms are governed by the laws of Hong Kong (SAR), which is where Dawnshine EverGreen Limited is based and from where our glasshouse operates. Where a dispute cannot be settled between us amicably, both you and we first agree to try mediation with a neutral third party before any formal action, and either side may then take the matter to the courts of Hong Kong.

Nothing in this section removes any right you hold under the law of the place where you live that cannot be waived by agreement. We would always rather find a fair answer at the garden bench than in a courtroom, and our team will always attempt a reasonable discussion first.
